Employing people from outside of the UK can be very confusing, here you will find a how-to-guide on employing individuals to ensure you comply to UK employment law, following BREXIT.

Employment Checks

When employing individuals and before you can put them on payroll, HMRC and the Home Office requires you to check they have the right to work in the UK.

We’d always recommending checking they know what this means at the application stage and/or interview to save you time if they do not have the right to work in the UK.

Previous to Brexit, EU nationals could work across the EU and would only need to provide a copy of their EU passport. Anyone coming from outside of the EU was required to provide this and further documentation to provide they had the legal right.

If you are unsure as to what documents an employee must provide you when applying for work, you should review this checklist and always provide a copy of this checklist to the employee either at the interview stage or at the offer stage (earlier if unsure they will have the right to work in the UK).

Providing a copy of this Home Office Right To Work checklist can make it easier for you to withdraw an offer, if there is a language barrier.

Recruiting employees from the EU/or other countries

Any employees wishing to work in UK-based companies and reside in the EU, they will now have to qualify for the ‘UK Points-Based Immigration’. 

Existing EU employees 

If you have employees that are from the EU and wish to remain in the UK, they will need to apply for their right through the ‘EU Settlement Scheme’.
